OVERVIEW
Welcome to WakaWax. The terms “we”, “us” and “our” refer to WakaWax, operated by A&N Universal Pty Ltd.
WakaWax operates this store and website, including all related information, content, features, tools, products and services, to provide you with a curated shopping experience (the “Services”). WakaWax is powered by Shopify, which enables us to provide the Services to you.
These terms and conditions, together with the policies referenced in them (the “Terms of Service” or “Terms”), describe your rights and responsibilities when using the Services.
Please read these Terms carefully because they contain important information about your legal rights, responsibilities, warranties and limitations of liability.
By visiting, interacting with or using our Services, you agree to these Terms and our Privacy Policy. If you do not agree to these Terms or our Privacy Policy, you should not access or use the Services.
Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy provided by the Australian Consumer Law or any other applicable law that cannot lawfully be excluded, restricted or modified.
SECTION 1 – ACCESS AND ACCOUNTS
By agreeing to these Terms, you represent that you are at least the age of majority in your state, territory, province or country of residence. If you permit a minor dependent to use the Services on a device you own or manage, you accept responsibility for their use of the Services.
To access certain parts of the Services or purchase our products, you may be required to provide information such as your name, email address, billing address, payment information and shipping address.
You represent that all information you provide is correct, current and complete and that you have the necessary authority to provide that information.
You are responsible for maintaining the confidentiality and security of your account credentials and for activity conducted through your account. You must not transfer, sell, assign or license your account to another person.
SECTION 2 – OUR PRODUCTS
We make reasonable efforts to provide accurate descriptions and representations of our products and services. Product colours or appearance may vary slightly depending on the device, screen settings and configuration used to view our store.
All product descriptions, prices and availability are subject to change without notice. We reserve the right to discontinue a product or limit the quantities offered to any person, geographic region or jurisdiction.
Our products come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these Terms affects your rights where a product is faulty, unsafe, not of acceptable quality, does not match its description or is not fit for a disclosed purpose.
You are responsible for reading and following the product directions, warnings and recommended usage instructions supplied with WakaWax products.
SECTION 3 – ORDERS
When you place an order, you make an offer to purchase the selected products. Your order is not accepted until WakaWax confirms its acceptance. Payment must be authorised and processed before an order can be accepted.
We reserve the right to accept, reject, change or cancel an order where reasonably necessary, including because of product availability, suspected fraud, pricing errors, payment issues or delivery restrictions.
If we reject, change or cancel an order, we will make reasonable efforts to contact you using the email address, billing address or telephone number provided with the order. If we cancel an order after payment has been processed, we will refund the applicable amount to the original payment method.
Please review your order carefully before submitting it. You may request cancellation until your order has been fulfilled. Once an order has been fulfilled or dispatched, it cannot be cancelled and our Return and Refund Policy will apply.
Purchases may be returned or exchanged only in accordance with our Return and Refund Policy and your rights under the Australian Consumer Law.
SECTION 4 – PRICES AND BILLING
Prices, discounts and promotions may change without notice. The price charged will be the price displayed when the order is placed and will appear in your order confirmation.
All prices are displayed in Australian dollars (AUD) and include GST where applicable, unless otherwise stated. Shipping charges are displayed separately during checkout.
Prices displayed on our online store may differ from prices offered through physical sales channels, wholesale arrangements, third-party stores or other sales platforms.
We may periodically offer promotions governed by separate terms and conditions. If promotional terms conflict with these Terms, the specific promotional terms will apply to that promotion.
You agree to provide accurate, current and complete purchase, payment and account information. You agree to update this information when necessary so we can process transactions and contact you about your order.

Charges incurred by you will be honoured by your payment provider.

You will pay the displayed product price and any applicable shipping charges and taxes.
SECTION 5 – SHIPPING AND DELIVERY
WakaWax currently ships within Australia using Australia Post.
Standard orders are normally dispatched within 2–3 business days. Express orders are prioritised and normally dispatched within 1 business day. Dispatch may take longer during public holidays, promotional periods, unusually high demand or circumstances outside our reasonable control.
Standard shipping costs $10 and is free for orders of $150 or more. The estimated Standard delivery time is 2–8 business days after dispatch.
Express shipping costs $15. The estimated Express delivery time is 1–4 business days after dispatch.
Delivery times are estimates and may vary depending on the destination and Australia Post’s delivery network. We do not guarantee an exact delivery date, but we will provide reasonable assistance if an order is significantly delayed, lost or damaged during delivery.
Customers are responsible for providing a complete and accurate delivery address. Additional shipping charges resulting from an incorrect or incomplete address may be payable by the customer, except where the issue was caused by WakaWax.

SECTION 6 – INTELLECTUAL PROPERTY
The Services and their contents, including trademarks, branding, text, images, graphics, product reviews, videos, audio, designs and arrangements, are owned by or licensed to WakaWax and are protected by Australian and applicable international copyright, trademark and other intellectual property laws.
These Terms permit you to use the Services for lawful personal purposes. You must not reproduce, distribute, modify, publicly display, publicly perform, republish, download, store, transmit, sell or commercially exploit material from the Services without our prior written permission, except where permitted by law.
Nothing in these Terms grants you a licence or other right to any patent, trademark, copyright or other intellectual property belonging to WakaWax, Shopify or another party.
WakaWax’s name, logos, product names, service names, designs and slogans are trademarks or branding belonging to WakaWax or its licensors. They must not be used without prior written permission.
Shopify’s name, logo, products, service names, designs and slogans are trademarks of Shopify. Other names, logos and trademarks displayed through the Services belong to their respective owners.
SECTION 7 – OPTIONAL TOOLS
We may provide access to tools and functionality offered by third parties. We do not necessarily monitor or control these tools.
Third-party tools may be provided “as is” and “as available”, subject to the terms and policies of the relevant third-party provider. To the extent permitted by law, we are not responsible for loss arising solely from your use of an optional third-party tool.
Your use of an optional tool is at your discretion. You should review and understand the applicable third-party terms and privacy practices before using it.
New features, tools and resources that we introduce through the Services will also form part of the Services and will be subject to these Terms.
SECTION 8 – THIRD-PARTY LINKS
The Services may contain material, functionality or links provided by third parties.
We are not responsible for examining or verifying all content, products or services made available through third-party websites. If you access a third-party website, you should review its policies and terms before making a transaction or providing personal information.
To the extent permitted by law, WakaWax is not responsible for harm or loss caused by a third-party website, product or service that is not operated or supplied by WakaWax.
Questions or complaints concerning third-party products and services should be directed to the relevant third party. This provision does not limit any rights you may have against WakaWax under applicable law.
SECTION 9 – RELATIONSHIP WITH SHOPIFY
WakaWax is powered by Shopify, which provides the ecommerce platform that enables us to provide the Services.
Sales and purchases made through our store are made directly between you and WakaWax. Shopify is not the seller of WakaWax products and is not responsible for fulfilling orders or providing remedies concerning products sold by WakaWax.
To the extent permitted by applicable law, you release Shopify and its affiliates from claims arising solely from purchases and transactions between you and WakaWax. Nothing in this section limits rights that cannot lawfully be excluded.
SECTION 10 – PRIVACY POLICY
Personal information collected through the Services is handled in accordance with our Privacy Policy. Certain personal information may also be processed by Shopify in accordance with the Shopify Consumer Privacy Policy.
Because Shopify hosts the Services, Shopify collects and processes certain information relating to your access to and use of the Services. Information submitted through the Services may be transmitted to Shopify and other service providers, including providers located outside the country where you reside, where this is required to provide the Services.

SECTION 11 – FEEDBACK AND REVIEWS
If you voluntarily submit, upload, post, email or otherwise provide ideas, suggestions, feedback, reviews, photographs, proposals or other content (“Feedback”), you grant WakaWax a non-exclusive, worldwide, royalty-free licence to use, reproduce, modify, publish, distribute and display that Feedback for the purposes of operating, improving and promoting the Services.

You must not use a false identity, misrepresent the origin of Feedback or submit malware or harmful code.
SECTION 12 – ERRORS, INACCURACIES AND OMISSIONS
Information displayed through the Services may occasionally contain typographical errors, inaccuracies or omissions relating to product descriptions, pricing, promotions, shipping charges, delivery estimates or availability.
We may correct errors and update information when discovered. Where an error affects an order already placed, we will contact you and provide an appropriate option, which may include confirming the corrected information or cancelling the affected order and providing a refund.
Nothing in this section limits your rights under the Australian Consumer Law.
SECTION 13 – PROHIBITED USES
You may access and use the Services only for lawful purposes.
You must not use the Services:

An Agent must not access or interact with the Services in a deceptive manner or circumvent measures designed to identify, restrict or control automated access.
Where technically applicable, an Agent must identify itself accurately, must not mimic human behaviour to evade detection and must not circumvent CAPTCHAs or other security controls.
We may use reasonable technical measures to control or restrict automated access to the Services.

We may suspend or terminate your access to the Services where reasonably necessary, including if you materially breach these Terms, engage in fraudulent or unlawful activity or threaten the security or operation of the Services.
You will remain responsible for amounts properly due up to the termination date.
Sections that are intended by their nature to continue after termination will remain effective, including provisions relating to intellectual property, feedback, liability, indemnification, privacy, governing law and outstanding payment obligations.
SECTION 16 – DISCLAIMER OF WARRANTIES
Nothing in these Terms excludes, restricts or modifies any consumer guarantee, warranty, right or remedy provided by the Australian Consumer Law or another applicable law that cannot lawfully be excluded, restricted or modified.
General information made available through the Services is provided for informational purposes. Although we make reasonable efforts to keep information accurate and current, we do not guarantee that general information will always be complete or suitable for every individual circumstance.
Except for rights and guarantees that cannot lawfully be excluded, the Services are provided on an “as available” basis. We do not guarantee that website access will always be uninterrupted, secure or error-free.
You should follow all product directions and test the product on a small, inconspicuous area where appropriate before broader use.
SECTION 17 – LIMITATION OF LIABILITY
Nothing in this section excludes, restricts or modifies liability, rights or remedies that cannot lawfully be excluded, restricted or modified under the Australian Consumer Law or another applicable law.
To the maximum extent permitted by law, WakaWax and its directors, officers, employees, contractors and service providers will not be liable for indirect, incidental, special or consequential loss that was not reasonably foreseeable and did not arise directly from our breach of these Terms or applicable law.
Where our liability can lawfully be limited, it will be limited to the remedy required or permitted under applicable law.
SECTION 18 – INDEMNIFICATION
To the extent permitted by law, you agree to indemnify WakaWax and its directors, officers, employees, agents and service providers against third-party claims, liabilities, losses and reasonable legal costs resulting directly from:

Fraudulent, malicious or intentionally harmful conduct by you.
Your obligations under this section will not apply to the extent that a claim was caused by the negligence, unlawful conduct or breach of these Terms by WakaWax.
We will notify you of a relevant claim and provide a reasonable opportunity for you to participate in its defence.
SECTION 19 – SEVERABILITY
If any provision of these Terms is found to be unlawful, void or unenforceable, that provision will be enforced to the fullest extent permitted by law or severed to the minimum extent necessary.
The remaining provisions will continue to be valid and enforceable.
SECTION 20 – WAIVER AND ENTIRE AGREEMENT
A failure by WakaWax to exercise or enforce a right under these Terms does not constitute a waiver of that right.
These Terms and the policies referenced in them form the agreement between you and WakaWax concerning your use of the Services and supersede previous communications relating to the same subject matter.
Nothing in this section excludes representations, guarantees or rights that cannot lawfully be excluded.
SECTION 21 – ASSIGNMENT
You may not transfer or assign your rights or obligations under these Terms without our prior written consent.
We may transfer or assign our rights and obligations as part of a sale, merger, restructure or transfer of our business, provided that doing so does not reduce rights available to you under applicable law.
SECTION 22 – GOVERNING LAW
These Terms and any separate agreements through which we provide the Services are governed by the laws of New South Wales, Australia.
You and WakaWax submit to the jurisdiction of the courts of New South Wales and the applicable Commonwealth courts of Australia.
Nothing in this section prevents a consumer from exercising rights available under any mandatory law applicable to them.

Headings are included for convenience only and do not limit or otherwise affect the interpretation of these Terms.
SECTION 24 – CHANGES TO THESE TERMS
You may review the current version of these Terms on this page.
We may update these Terms to reflect changes to our Services, business practices or legal obligations. Updated Terms will be posted on our website with a revised “Last updated” date.
Where required by applicable law, we will provide notice of material changes. Changes will apply from the effective date stated in the notice and will not retrospectively remove rights that have already arisen.
